Supervisor Knox called the special meeting to order at 10:00 AM.  Board Members Present was:  S. Knox, C. Harwood, F. Folkema, J. VanderMeulen and J. VandenBerg.  There were seven guests including Attorney for Ensley, Steven Stapleton, Ellick attorney, Ross Leisman, mediator, Bruce Neckers (and his intern), Bob Hall, Robert Ellick and Donna Ellick.  

The meeting was turned over to Mr. Neckers.  He explained his procedure for facilitating an agreement between the Township and the Ellicks.

VandenBerg left the meeting at 2:15PM. 

After several hours of consulting each party to the suit, an agreement was formed.  There was a motion by Knox/Folkema to accept the draft drawn up by Mr. Neckers on June 25, 2008.  A roll call vote was taken where Folkema, VanderMeulen, Harwood, and Knox voted aye.  VandenBerg was absent.  The motion passed.  The agreement was signed by Mr. Stapleton, Mr. Knox, Mr. Leisman, and Mrs. Ellick.

Mr. Leisman, Mr. Neckers, (and his intern) R. Ellick and D. Ellick all left the building.

There was a motion by Knox/VanderMeulen to go into closed session to discuss the pending litigation.  Folkema left the building.  The Board was given an update on the Ensley Sand and Gravel Case.  There was a motion to close the closed session by Harwood/VanderMeulen.  All affirmed.  Folkema returned.  There was a motion to open the regular meeting by Knox/VanderMeulen.  All affirmed. 

There was a motion to adjourn at 3:16 pm.  All affirmed.
